Capital Punishment 1 Capital Punishment Makayla Jones University of Charleston Comm 102 Amy Taylor July 29, 2021 Capital Punishment 2 Research Paper Proposal When choosing the research topic of Capital punishment, I wanted to research other ways the handle a variety of crimes. I want to avoid people getting multiple punishments like the death penalty on top of a life sentence. Should Capital Punishment be illegal? I don’t think it should be illegal but the variety of crimes that this punishment is given out for is vast. Some of the criminal acts shouldn’t even be criminalized. Depending on the country that you get sentenced in depends on the offences that count under death penalty. Drug- related offences do not justify execution. The death penalty can be considered Inhumane in certain situations but in others it can be considered the rightful punishment. The article also goes into depth about execution methods whereas some places behead their inmates’ other places use a lethal injection. It goes into “Modern Era” saying, “the Supreme Court declared that under then-existing Capital Punishment 3 laws "the imposition and carrying out of the death penalty… constitutes cruel and unusual punishment in violation of the Eighth and Fourteenth Amendments."” So basically, the Supreme Court said in 1972 that the act of executing someone for a crime they might have committed is cruel and unusual punishment. They then speak on if the death penalty controls crime. Does the death penalty stop people from doing those specific crimes that are punishable of the death penalty? It also talks a little bit about how it gives the government too much power and some of the punishment to be given out to people because of their race or their class. Meaning that when people are getting sentenced you must be careful to make sure you’re not discriminating against color class, ethnicity, or any other things. In this article it goes into depth of how the death penalty affect African American people. There are 87% of black people sentenced to death versus 67% of white people on death row. Some of these are cases of misconduct but majority of the Capital Punishment 4 misconduct cases were black individuals. There are also other places like Hawaii and New York that don’t allow capital punishment. When reading through the article you can see that majority of the places that allow capital punishment are more in the south. Places like Alabama have multiple methods of execution. The most inhumane method would be lethal gas and firing squad. In New Hampshire the secondary method is hanging in all honesty that should be illegal because it could be misconstrued depending on who is being executed using the second method.
