No, an employer may not insist a prospective employee provide proof of naturalization or an Alien Registration Card.  Section 102 of the IRCA was enacted as an enforcement mechanism to discourage employers from discriminating against “foreign-looking” or “foreign-sounding” prospective employees (Twomey, 2013).  However, the prospective employee must complete the Form I-9 attesting he or she is legally employable (Twomey, 2013).  Additionally, employers may verify employment eligibility using E-Verify (Ivancevich and Konopaske, 2013).
