Dustin and Mike, both 12 years of age, are the best of friends. One of their favourite hobbies is to play Lords and Dragons, which can get very immersive. One day after school, they are playing a very intense game on the green in front of their houses. Dustin, who likes to make the games very realistic, produces a lighter and pretends that he is a fire-breathing dragon by lighting the lighter and waving it around in front of his face. Inspired by Dustin’s fire-breathing skills with the lighter, Mike also grabs the lighter and waves it around. Unfortunately, Mike waves the lighter next to a wheelie bin containing shredded office paper, which quickly catches fire. The fire then spreads from the bin to the adjoining houses and gardens, before engulfing most of the houses on the road. The damage totals €2 million, but thankfully nobody is hurt. Mike is seeking legal advice regarding any criminal liability he may have in relation to the damage. Your answer should make comparative reference to the law in England and Wales.
