OCCUPIER'S LIABILITY

In Hospitality Law, Occupiers' Liability is a field of tort law that concerns the duty of care owed by those who have control over a premise (through ownership or lease) to people who visit or trespass. The liability may arise from accidents caused by the dangerous condition of the premises, but the degree of liability may vary depending on who is the visitor or the premise.

Tort Law classifies three categories: invitees, licensees and trespassers. 

Based on the differences among these three categories and the following scenarios, determine which situations could lead to a civil lawsuit and why.

a) A courier delivers a parcel to your door.

b) A friend is invited to a dinner party at your home. He slips and falls, injuring his knee on your newly waxed floor.

c) A burglar breaks into your Bed &Breakfast. While crossing the living room, he trips over a rug. He falls and breaks his leg.

d) A job applicant enters your restaurant to hand in his resume. He pierces his hand on a nail sticking out of a counter.

e) A homeless breaks into your restaurant to have shelter for the night. He gets electrocuted by the electrified system you installed at the entrance.
