Butler 123 Taxiway Lane Runway, ST 12345-6789 Dear Mr. Butler: RE: File # 020WA2004 This office is investigating an increase is ATC reported altitude deviations with your company. This action is contrary to Title 14 of The Code of Federal Regulations (14 CFR 91.121 (1), (2)), commonly referred to as the "Federal Aviation Regulations." This letter is to inform you that the incident is under investigation by the Federal Aviation Administration (FAA). It has been brought to our attention that in the last 6 months 26 separate occurrences of pilots working in the capacity of crewmember have failed to comply with 14 CFR 91.121 (1), (2). Nine of those events ATC has filed a Deviation on the incident. The other seventeen of the events were sole-source and discovered through ASAP. Only three of the reported nine were covered in ASAP resulting in Letters of Warning or Correction, the other six crews received certificate action. As the VP of Flight Operations for Butterfly Airline it is your responsibility under 14 CFR 121.533 (a) to ensure crewmember compliance with the Federal Aviation Regulations. Our concern is the potential for an incident or accident due to loss of separation with another aircraft. In the above stated incidents four events involved loss of separation that required immediate evasive action. We ask that you have the following information forwarded to us for review in this matter. 1. Training materials used in ground and flight training that address the issue 2. Any information that has been put out to the crewmembers informing them of past non­compliance 3. Corrective action the company plans to institute to ensure compliance in the future.
