JWC carries out the mulesing of its lambs. That is a veterinary-surgical procedure. It involves removal of layers of skin from around the tail of the lambs. Mulesing helps to control blowfly strike. The New England Animal Liberation Foundation Ltd (ALF) is a company limited by guarantee. One of ALF’s objectives is to advocate legislation banning the practice of mulesing. ALF has launched a campaign in Italy. The campaign aims to stop Italian mills buying fine wool from New England woolgrowers who conduct mulesing. Without JWC’s consent, ALF chartered the local shire council’s recent purchase, an ex-military, low-noise helicopter. ALF organized an on-board film crew with long range telescopic equipment. The shire council’s pilot flew the helicopter. It carried the shire council’s livery prominently on the sides and underneath its fuselage. The helicopter surreptitiously flew over JWC’s property filming the mulesing of their lambs. Both local and international television news programs screened the film of the mulesing. The graphic pictures were distressing, particularly for children. The revelations of the mulesing of the lambs generated an adverse reaction in the buying public of wool garments. The February 2019 Newcastle fine wool sales were the most recent. At those sales, Italian buyers refused to buy wool from sheep that the woolgrower had mulesed. Following that disastrous sale, JWC commenced urgent proceedings against ALF by filing a statement of claim in the Supreme Court of New England claiming: 1. That ALF was in breach of JWC’s equitable right to confidentiality in the way it carried on its sheep husbandry; the filming of the mulesing was an unauthorized disclosure of personal information; or 2. That ALF unlawfully invaded JWC’s privacy; or 3. That ALF was in breach of both of the above. (role of the shire counsel).
