Kirkham has contended that although the test of maladministration ‘has proved to be a powerful and adaptable tool for the task to which the [PCA] was assigned’, the ‘lack of clarity as to the meaning of the maladministration test is problematic . . . as it effectively grants the [PCA] a high degree of autonomy’.
