This assignment's focus is on Human Rights. You may choose a role as either the HR Consultant for the terminated employees or as the Company representative of CRX. You will argue your case asking for the appropriate remedy(ies) or defending your position(s) and explaining the lack of grounds. You will also choose your forum - either as a human rights complaint or as a wrongful dismissal action.

The written report should be written in the following format;

  • Choice of forum and why
  • Summary of Issues - this is where you summarize any grounds of discrimination that are revealed, any other legal grounds; or the arguments/grounds why CRX is not at fault
  • Issues - as employee, here you provide details of each ground of discrimination or other grounds. You should make reference to the applicable section(s) of any statute and provide examples of relevant case law. For CRX, here is where you would provide details to defend the employees' claims, making reference as necessary to statute and case law.

The text has examples of cases. You should be able to build your written submissions from those. You may also use online resources such as canlii.org to find more examples. However, if you use online sources, be sure that the cases support your position, and that you have read the cases.

  • Conclusion - this is where you draft your conclusion and state the remedy(ies) sought or summarize your defence.

This is not meant to be an extensive report. Three to four pages maximum should be sufficient to outline your position and present your case.

 

 

Gender discrimination:

Dexter and Mary found themselves in a similar situation because of his sexual orientation. When Mary started working with Frank, she felt uncomfortable because, after some time, Frank found that Mary is a lesbian and his behaviour change toward her. Dexter was also always listening to inappropriate comments because of his sexual orientation and the way he dressed.

Frank has a picture showing that he was standing in an anti-gay protest which possibly shows his nature and what he thinks of people who are gay.

 

Discrimination related to disability:

This discrimination happened with Vincent because he only had one leg, and the other leg was prosthetic. Also, some situations in the office made him feel embarrassed.

People with disabilities experiencing difficult life, but that does not mean there is no value in life. We must look at people with disability equal, without prejudice.

 

Discrimination relates to race: Todd make remarks about all employees and comment about Carl's living his native country and come to Canada, what is making him uncomfortable.

 

Issues found in the case concerning human rights involve gender and race discrimination and differences related to disability.

The grounds on which CRX was at fault are errors in the investigation and low environment.

 

Looking for examples of relevant case law which support my position as a the Company representative of CRX.
