Would you ever believe someone of an accused crime? Is individual's innocent until proven guilty? The answer is yes, and it's pretty unbelievable how many constitutional protections are afforded to people with the most heinous crimes. This week's readings covered a good amount of the unique classics about law altogether and explained criminal law and criminal proceedings. Criminal Procedures always will have protective rights afforded to the individual during the criminal process. The 'bill of rights" says it all! It's how we know of law today (Stevens, 1996) ever since 1791 when James Madison was adopted the first ten amendments became the law of the land and the people; of course, it has evolved; however, the simple understanding of this is the bill of rights spells out the immunities and protections granted to the citizens of the United States of America.

Furthermore, with this being noted, it guarantees (Spolin, 2014) civil rights and liberties as stated in this week's readings rights and freedoms such as the freedom of speech, religions, the right to be afforded an attorney, the right to a fair trial; due process, the right to assembly, the right to petition, and the right to vote. Also, anyone accused of a crime is protected by the 4th Amendment: right to be free from unreasonable search and seizure, 5th amendment right to remain silent, due process of law. In addition, the 6th amendment right to counsel and the 8th Amendment prohibits excessive bail, fines, cruel and unusual punishment.

          Over the past few decades, the interpretation of these prosecutions evolved radically. Finally, (Constitution, 2021) on December 15, 1791, The Modern United States ratified the bills of rights and the first ten amendments to the U.S. Constitution, confirming the constitution, in other words, reevaluating the citizens' rights. As we know, the constitution and the bill of rights were designed to establish the government. The Declaration of independence has always been the same; however, if you consider the constitution, it has been amended 27 times, so just how adequate are these protections? These amendments are effective as they guarantee fundamental rights and civil liberties to the people of the United States. One thing to add with this all is that the bill of rights cannot protect citizens by itself; only when applied by the government does it have power; the bill of rights prevents the federal government from taking away our rights as humans. Overall, these protections are adequate but can be challenged in a Court of law.

          I believe the first Amendment is the most important because it gives us people the freedom of speech, religion, expression, assembly, and the right to petition. This is what makes America Everyone gets to voice their opinions practice their beliefs, and more! So, hands down, I say the first Amendment. I do not think those accused of a crime are given too many rights; I think it's perfect the way it is. I also believe that everyone is innocent until proven guilty. The truth always comes out one way or another.
