Employment Hearing Group Project Overview In this assignment you will analyze an employment law court decision to identify the common law principles related to employment law, articulate the employer and the employee’s (i.e. the parties) positions, and outline the court’s decision and rationale. This assignment is worth 25% of your grade. Instructions • • • • • • • This is a group assignment. Using the internet, choose a case from the www.canlii.org website. Choose your case from the Alberta provincial jurisdiction. Critically analyze the case using the FILAC model and in relation to employment law topics covered in the course. In particular, identify the common law principles related to employment law that the case highlights. Determine the facts of the case; the issues before the court and both the employer and the employee’s position and/or arguments before the court. Also determine the court’s decision and rationale for the decision. Write a maximum 10-page report including title page and reference page that includes the details in the Marking Criteria table below. Your paper should be written using sections that correspond to the numbers. You are also required to record a presentation using PowerPoint which should be a maximum of 15 minutes. Everyone in the group is to be involved in the presentation. Upload a copy of the case you used from CanLII to D2L. Please see the Rubric to understand how the assignment will be evaluated. Marking Criteria Total marks possible – 100 Marks will be awarded for each of the following sections Written Presentation 1. Provide a brief introduction that outlines what your paper will discuss. Your introduction should include the title of your case, the case citation, and a brief overview of who is involved in the case, the jurisdiction where the case was heard, the year the case was heard, and the main statute that the case falls under. 2. Summarize the relevant facts of the case in your own words. 3. Summary the issues of the case in your own words from both the perspective of the parties involved in the dispute. Remember that issues are the dispute that is in front of the court to resolve. 4. Identify which party has the onus of proof which is determined by the type of issue it is and the employment law in question. Provide rationale for why the onus of proof falls where it does with support from concepts discussed in the course. 5. Identify at least three common law principles related to employment law that are highlighted in this case. This includes applying concepts that you learned from course content 6.
