In anticipation of your research you should consider the following questions as possible sub-topics for your paper:

  • In general, what are the advantages and disadvantages of federalism in combating the COVID-19 pandemic?
  • How does a pandemic present unique challenges to federalism as an organizing principle to solve public policy problems?
  • Can the pandemic be eliminated by states only? By the federal government only? (Why?)
  • What are the limits of each level in this crisis?
  • How has politics played a role in the governing of this crisis?
  • What are the most important issues that states, and the federal government must be concerned with? (There are many.)

In other words, the generalized and specific questions that can be raised by this crisis as it relates to federalism are endless. Once you have conducted your research on the matter and have read your sources, please construct a 6-7 page paper. You must establish a thesis statement for your essay. The thesis tells the reader what your paper and analysis aim to achieve and substantiate. The thesis statement is often found in the introductory section of your paper. However, some thesis statements are delayed and exist elsewhere as the paper is developed. Ultimately, it is up to you, the student, to decide what your thesis is, and thus, what the particular focus of your paper will be. You can take a broad approach. Or, you can take a specific approach and write only about one aspect of the crisis in relation to federalism (e.g., economic, medical equipment, testing, CDC and preparation policy etc…).

ANALYTICAL PAPER (120 Points Total) TOPIC: Federalism and COVID-19 ASSIGNMENT OVERVIEW: The COVID-19 public health crisis (Corona Virus) has caused renewed analysis and reflection on the advantages and disadvantages of the United States’ system of federalism. Week #2, Module #3 provides the background and information necessary to gain a basic understanding of federalism. As noted there, federalism is defined as the “constitutional division of power between the national and subnational governments.” In the case of the United States, this means constitutional division of power between the federal (national) government and the states. Both levels of government have a constitutional right of existence and cannot be eliminated by the other. The two levels of government share power in some areas and are given exclusive particular and distinct powers in other areas. If there is conflict in any area between the two, the Supremacy Clause of the U.S. Constitution makes clear that federal and U.S. Constitutional law prevails. It is rather obvious that maintaining a system of divided power through federalism offers many positive aspects and advantages, as well as many drawbacks. Conservatives have traditionally embraced state power (decentralized power) to that of centralized power from the federal government. Liberals embrace state power and rights, but also believe in a stronger role for the federal government in managing economic and other matters of the nation. Former President Trump, certainly having overseen a unique and unconventional Presidential Administration, fluctuated back and forth between promoting individual State power as the proper way to address the COVID-19 crisis, to that of declaring his unilateral and exclusive powers to manage the crisis at the federal level. Thus, the traditional ideological lines were blurred by the former President’s handling of this emergency. President Biden’s approach to utilizing multiple levels of government seems apparent and somewhat conventional but is still evolving. It is important to know that even if the federal (national) government decides to allow states to manage the crisis themselves, the federal government can still, and usually does, play a large role in helping to coordinate state action and to remove barriers and inappropriate competition that might exist among and between states during a crisis such as this. GRADING: Content Students will be graded on the accuracy and sufficiency of the content within the paper. It does not matter whether I agree with any student’s political affiliation or opinions. If you are a supporter of President Trump or not, Republicans or Democrats, etc.... is of no concern to me or to the outcome of your grade. You are being graded entirely on the legal, historical, and intellectual honesty of your paper. Presentation and Approach: Papers should be presented in an appropriate academic format. The papers are to be double-spaced. I require one-inch margins, page numbers, a title and your name at the top of the page. You must have an identifiable thesis statement within the essay. And, you must use MLA, APA or Chicago Manual of Style formatting; your choice. You must have a bibliography of at least 7 sources, and works cited of at least 4. Please be sure to incorporate your answers into a fluid, seamless essay that uses topic sentences and paragraphs to transition from sub-topic to sub-topic. You will also be graded on proper sentence structure and articulation.
