As this is L5 work and will contribute, in part, to your degree award, the quality of presentation, ie spelling, grammar and referencing must be at the appropriate level. A nominal percentage of 10% is allocated in the marking criteria to this area to reward good presentation or penalise minor errors. Written work which is below the general standard expected at L5 will invariably lose marks against other criteria as knowledge and understanding will not be clearly demonstrated if your expression is unclear. If you need assistance with these skills, ask for guidance or refer to the many resources available in SOL. 
Assessment Task 
FRUIT TRADER shipped 2560 boxes of bananas aboard MONTGOMERY INC's reefer vessel the "THE ICY PRINCESS" from Guayaquil, Ecuador on the 1st February 2021. MONTGOMERY INC issued FRUIT TRADER with three bills of lading that stated, amongst other things: 
Bill of Lading 1  
"Shipped on board the "The Icy Princess" in Guayaquil, Ecuador on the 1" February 2021 in apparent good order and condition 1,000 BOXES of bananas. To be delivered to FRUIT TRADER or order in Antwerp, Belgium." 
Bill of Lading 2 
"Shipped on board the "The Icy Princess" in Guayaquil, Ecuador on the 1" February 2021 in apparent good order and condition 800 BOXES of bananas. To be delivered to FRUIT TRADER or order in Antwerp, Belgium." 
Bill of Lading 3  
"Shipped on board the "The Icy Princess" in Guayaquil, Ecuador on the 1" February 2021 in apparent good order and condition 760 BOXES of bananas. To be delivered to FRUIT TRADER or order in Antwerp, Belgium." 
The bills of lading are subject to English law and jurisdiction. 
On the 18' February 2021 FRUIT TRADER sold "1760 BOXES of bananas; price USS 18.70 per BOX C.I.F. Antwerp; shipment period February 2021" to DIF FRUIT tendering to DIF FRUIT the bills of lading (numbers 1 and 3), an insurance policy and a commercial invoice. 
The "The Icy Princess" arrives in Antwerp on the 23rd FEBRUARY 2021 where it is discovered that the bananas were infested by insects as the ships holds were not fumigated prior to loading the cargo. The bananas are now valueless. 
Write an essay discussing what claim, if any, DIF FRUIT have for the damaged bananas. Include in your essay discussion on the following areas - whom should DIF FRUIT claim against and what defences, if any, may the defendant rely on to defeat or limit any claim. 
Your essay should also incorporate appropriate case law to illustrate your legal argument.
