As an unbiased law enforcement officer, tell us whether Comey made the correct ethical choice and why?  Could he have waited to after the election?  Why or why not?

Expert Solution

As an unbiased law enforcement officer, The FBI director James Comey violated a federal law which is the Hatch Act. The Hatch act actually protects the candidates by forbidding FBI or other agencies to conduct, discuss or raise any cases to persuade the voters. To give a brief background, the law was passed in 1939 by President Franklin D. Roosevelt and it clearly states the prohibition of FBI cases to be opened during political activities.

In my sole opinion, If James Comey would have withheld the information and waited until after the election, he still would have had to explain his knowledge about the case such as how long did the FBI have the information and how many emails were present? Voters believe this type of information is pertinent in deciding their vote.

James Comey is/was in a “NO WIN” situation. Either way, his ethics were put on the line. He believed it was ethically right to produce the information in order to make citizens aware before voting.

Withholding something of importance is just as ethically damaging to the public however, the law must be maintained. As a leader of the FBI, he must uphold responsibilities of his position. He is ethically unjust because he broke the law.

James Comey could have upheld his ethical standard by obeying the hatch law and reporting his findings after the election  was completed. We are speaking of a 11 day time frame.

James Comey could have prepared all pertinent documents s and reported after the election.
