Kelly Green Landscaping had signed a contract with Gragg Farms to purchase trees from Gragg Farms. When the trees arrived they were unhealthy and had not been taken care of. Upon arrival, Kelly Green Landscaping and his team decided they did not want the trees and want Gragg Farms to take them back. According to the contract, Kelly  Green Landscaping must pay for the trees prior to inspection. No payment had been made. Kelly Green Landscaping and his team continue to care for the trees until they could be picked and eventually planted them in the ground in which many died due to poor health prior to their arrival. In this case, they found that Kelly Green Landscaping owed the payment for the original trees according to the contract the payment was needed before the inspection of the trees. Gragg Farms although needs to reimburse Kelly Green Landscaping for the labor of his employees for taking care of the trees, recovery, and other financial charges which ends up being a $460.70 difference to be paid to Kelly Green Landscape.
