Generally speaking, medical records of any type (including drug use) should be considered private property of the employee. I strongly believe in the privacy of man. I do not espouse socialism in any form whatsoever, for I believe that man thrives most when free and independent. Of course, he is free to join himself to others voluntarily; however, never should it be under coercion. One of the basic tenets of socialism is the absence of privacy, or perhaps we should say, the absence of private property. Under a socialist state, all property is "collectively" owned. That's just a subtly polite way of saying that the government owns it and you don't.

Your body is your private property. It belongs to no one else, and no one else may lay legitimate claim to it. What goes into it and what comes out of it is your responsibility, for good or for evil. Of course, you will be held accountable in society (and in the heavenly court!) for your actions, and this is good, for with responsibility comes accountability. Freemen accept the responsibility inherent in freedom. Slaves do not.

An employer has no right to know what goes on inside someone else's private property. Therefore, as the employer has no right to know what goes on inside your home (another form of private property), he also has no right to know what goes on inside your "home," i.e. your body.

Now, if an employee wishes to divulge certain issues with said employer, then that would be fine as it would be voluntarily and not coercive. No man should have to relinquish ownership over his private property in order to provide a roof over his head or clothes on his body or food in his stomach. It degrades man.

All that being said, what if an employee's work habits are being negatively affected by some form of drug use? Then clearly, the employee has the responsibility to inform his employer of any potential problem. Likewise, an employer has the right and responsibility to protect its workplace. Therefore, if the employer feels that something is amiss, he has the right to ask questions. In addition, in serious situations, the employee could be dismissed for cause. This would be acceptable.

In all situations, open dialogue is the best way to go. But it should be initiated by the employee. The employer has no such right to the private knowledge of another. The employer may ask, but that's about it.
