Expert Solution

Answer:

Car fringe benefit mostly occurs when an employer makes a car available for private use for the employee. The taxable value for a car fringe benefits is calculate buy either of two methods:

Statuary formula method

Cost operating method

One must use the statutory method unless they elect to choose the operating cost method. However, to use the operating cost method one must have kept adequate FBT records.

In Nikita's case, we will use the statutory formula method.

The formula is:

Taxable value = (A x B x C) - E

D

Where:

A = the base value

B = statutory percentage

C = days for available for private use.

D = the number of days in the FBT year

E = employee contribution

Please refer from PCG 2018/3

Base value is the original price + delivery charges

So base value = 44,000 + 2,000 = 46,000

Refer the base value from Taxation Ruling TR 2011/3.

A flat statutory rate of 47% applies ending 31st march 2019

The car is treated as available for private use is the car is not at employer's premises,

again, car is considered available for private use where it is in the workshop for routine servicing or maintenance.

Therefore, both when the car was parked at the airport and when it was at repair shop is considered as available for private use.

Available for private use 10 + 5 = 15 days

.

The number of days in the FBT year are total days from 1st May 2019 - 31st march 2020 = 335 days

Employee's contribution = 770

Taxable value = (46,000 x 47% x15 / 335) - 770 = 198.05

FBT liability for Perisher Pty Ltd Weighting = $198.05
